That harm falls on policyholders denied the coverage they paid for, and on injured claimants whose recoveries are stalled or suppressed by the insurer on the other side. The law recognizes that insurers owe a duty of good faith and fair dealing, and allows recovery beyond the policy itself when that duty is broken.
